BAY CITY, MICH. -- The man charged with abusing -year-old Carnel Chamberlain just weeks before the child's death is returning to court to ask a judge to grant bail.

Anthony Bennett has been described as the last person to keep watch over Carnel Chamberlain before the boy disappeared on June 21. The child's remains were discovered last week under the family home on the Saginaw Chippewa Indian reservation near Mount Pleasant.

No one has been charged yet with Carnel's death. But Bennett is charged with assaulting him in late May or early June. He lived with the boy and Carnel's mother, Jamiee Chamberlain.

Defense attorney Anthony Chambers will ask a judge to release Bennett on bond Tuesday during a hearing in federal court in Bay City. Prosecutors want him kept behind bars.
