An Update on the School Board's Plan to Rename the Break

One of the hot topics recently in our Fact Finder segment was the debate about what to call the school break at the end of December. I told you how the Petoskey Public School board was considering changing the name of its break from Winter to Christmas break, and how legally they could. Dozens of you wrote in with strong opinions on both sides of the issue. But since that story aired there's been a new development and we have an update in this Fact Finder Follow up.

In our story we chose to stick to the legality of the name change, but there is another element. An email circulating written from the school board treasurer, vehemently stating that political correctness has gone too far, that we are a Christian nation and the break should be called Christmas break.

It is that email that has added a twist to how the school district decided to proceed with the possible name change.

In a written statement the board said it will not continue with plans to change the name of the break from winter break to Christmas break.

The statement reads, "Upon reviewing the legality of this change in light of Mr. Waldvogel's email of August 10th, 2009 it is the opinion of this Board, along with legal counsel, that the School District would not be successful in court if challenged. The ability or right to change the wording is not at issue. It is well settled that schools have the right to refer to the break as Christmas. Christmas is a federal holiday and the vacation period can be named as such as has been traditionally accepted. However, it is also well established that government actions (including Public School Boards) must have a secular purpose for their actions (Lemon v. Kurtzman, 403 U.S. 602 (1971)). The change to "Christmas Break" cannot be initiated or driven based on religious agenda. This Board does not wish to expend the District's limited resources on legal issues in which in all likelihood would not be successful."

So basically it comes down to intent. The board could call it Winter or Christmas without any problem, as long as there was no intent to push any one religion.

So Petoskey will join most, but not all northern Michigan School districts in calling the break Winter Break. But what do you think about the board's decision?

Okay I'm a agnostic but this is a little crazy. I was thinking good, christmas break needs to go but then i thought about the saying. MERRY CHRISTMAS. that line is so powerful and is used in every movie.
It wouldnt sound right if it was Merry winter . haha. no. Idk. do what you want america but later on do remember this, if you change it, how will this effect the christmas tree, the stalking, elfs ,santa claus, presents? ARE YOU going to change the name of those to? think!

Call it what it is. I grew up in Michigan. All 12 of my school years here it was always called Christmas break. That is what I will always call it.No big debate needed it is what it is.

So, being a Catholic, it doesn't matter if you lie to your kids? Your thinking is that since generations of Catholics have lied for so long it doesn't matter? I don't remember the commandment that said "Though Shalt Not Lie, Unless It Makes Your Kid Happy". Teach your kids what Christmas is supposed t be about, and they will be just as happy as they are now.

I am so very sad by this. Petoskey schools have surprised me. I was hoping that a school this far north would have pulled up their boot straps and helped in this small way to reclaim that which has been slowly taken from us. Our liberty. We were a nation founded on the christian faith. That should not be the only reason to say Christmas Break. They should call it Christmas Break to show they are proud of America and it's founding ethics it scribed in our Constitution and our Bill of Rights. Yes we should be tolerant of others but in no way should we allow those others to project our ways. Where are we going with all of this none sense of not showing who we are? When can we be AMERICA again?

I am Catholic. It amazes me that there is still an arguement over the word Christmas. I would prefer the break be called Christmas break, but who cares! Call it what you want, it is still a break for Christmas. It is a federal holiday and most all people get this day off. The people who fight SO hard to take the word Christmas out of it are the same people that celebrate Christmas and take the day off like the rest of America. And I bet their children have presents under the tree from Santa on Christmas morning. Why do you take the day off or celebrate Christmas if you are SO against the wording of it? Also, who cares that almost EVERYONE lies to their children about Santa. My parents did it to me, as theirs did to them. It doesn't make me less of a Catholic. It makes me a good mom, that loves to see the twinkle in her children's eyes when they see the presents Santa left them on CHRISTMAS morning. Who wouldn't enjoy that? So stop the fighting. Even people who don't "believe" still celebrate Christmas.

It seems to me that school boards particularly in this economic period have more important issues to be concerned about than what to call the break that occurs at Christmas time. Caill it what you will it happens over the Christmas period just as Thanksgiving break happens over Thanksgiving.

This is to "previous comments to go the other way too". You're absolutely right, they shouldn't have wasted my money to change the name in the first place. It's unbelievable the crap that people can find to complain about, and others let them get away with. This country has completely gone to crap because of it. Fight the fights that matter. I'm still trying to figure out how this can affect anyones lives?

I don't have a whole lot to say about this issue except that for one...it really does'nt matter to many about what a break in school is called. For two, the only people who should have a say in this, are the kids. There are some kids who do not celebrate Christmas or any other holiday. To change the name to fit the holiday would only make those kids who are the minority to stand out more. As anyone who went to school knows, kids can be very cruel. In the best intrest of them and for the people who could care less about that a holiday break is called..leave it be....thanx

What secularists don't want to admit is that this country was founded on principles that would (and did) make this country great through the prayerful guidance of Almighty God. The Constitution says NOTHING about separation of church and state, and only says that the U.S. would not make any one particular religion the country's official one. That's all. The phrase "church and state" came from a Supreme Court justice in the late 1940's who was a past member of the KKK and had an anti-Catholic bias. Secularists are using this misguided phrase as their excuse to remove all references that sound religious from the public square, including calling vacation time around Dec. 25 "Christmas Vacation." In case they've forgotten, Christmas has secular, as well as, religious symbolisms to it, so, there's nothing wrong with calling it "Christmas Vacation." Since the secularists want to remove all religious sounding references from the public square, maybe we should remove all smoking from the public square and see how THEY like it. After all, two can play that game.

Yes, take God out everything in our country. See what it has done to our schools by taking prayer and Bible reading and the Ten Commandments etc. out. Then Satan can take over. He's doing so already.

The same thing could be said of the first two comments on this issue. Maybe it was small minds, that need to find something else to do, and not waste so much tax monies, changing the name of the holiday in the first place, huh? Remember big thinkers, it was Christmas for many, many many years BEFORE, it was CHANGED to winter holiday! What amazes me these days is how much hipocricy there is in our society. Those that state their opinion, don't want to have to listen to someone that doesn't agree with them. We have a President and Congress that is setting a terrible example for the rest of us. Some people are saying out there, that if I don't agree with his policies that I'm a racist! What? That is just dumb small minded thinking. If someone thinks it important to get the name of a very important holiday changed back to the way it used to be, that doesn't make them small minded, hardly. It's really sad in our world today, sad, sad sad...

This Goes along with everything else that is wrong with our country. Right along with them removing "In God We Trust' from our Money to not allowing the Pledge fo Allegence to be said in school. I had to say the pledge when I was in school and it was never an issue till the courts started to allow people to sue for any little thing that they could. Who cares how the break is worded. The people that make these kind of things an Issue are the parents that should be using the energy to focus on there children. Cause they are the children that are the problem Students cause their parents are to busy making issues out of crap like this and not realizing what their kids are doing.

Maybe they should volunteer somewhere so that their mind and hands and mouths would be occupied, then they would not have time to dream this stuff up. These are the same people that ask us to refuse money that does not have "In God we trust" on it and refuse to let their children hear a speech from the President of the united States telling them to study hard and stay in school. Little minds, Can not fix large problems, just find ways to tear things down.

All right, climb down off your ridiculously high horses. Winter break or Christmas vacation, who cares? It's people that nit pick about this crap that are the same ones that start wars over religion. You might not blow anyone up, but you waste more time, money and resources than any other terrorist group. I am an Infidel and proud of it. I don't care what it's called, my kids are off and I get to lie to them about Santa. The people that are crying to call it Christmas, you know, the religious ones, lie to their kids. In what religion is that OK? For those that agree with me, shut up. If it weren't for Christmas, there would be no break.
