An Update on the School Board's Plan to Rename the Break

One of the hot topics recently in our Fact Finder segment was the debate about what to call the school break at the end of December. I told you how the Petoskey Public School board was considering changing the name of its break from Winter to Christmas break, and how legally they could. Dozens of you wrote in with strong opinions on both sides of the issue. But since that story aired there's been a new development and we have an update in this Fact Finder Follow up.
In our story we chose to stick to the legality of the name change, but there is another element. An email circulating written from the school board treasurer, vehemently stating that political correctness has gone too far, that we are a Christian nation and the break should be called Christmas break.
It is that email that has added a twist to how the school district decided to proceed with the possible name change.
In a written statement the board said it will not continue with plans to change the name of the break from winter break to Christmas break.
The statement reads, "Upon reviewing the legality of this change in light of Mr. Waldvogel's email of August 10th, 2009 it is the opinion of this Board, along with legal counsel, that the School District would not be successful in court if challenged. The ability or right to change the wording is not at issue. It is well settled that schools have the right to refer to the break as Christmas. Christmas is a federal holiday and the vacation period can be named as such as has been traditionally accepted. However, it is also well established that government actions (including Public School Boards) must have a secular purpose for their actions (Lemon v. Kurtzman, 403 U.S. 602 (1971)). The change to "Christmas Break" cannot be initiated or driven based on religious agenda. This Board does not wish to expend the District's limited resources on legal issues in which in all likelihood would not be successful."
So basically it comes down to intent. The board could call it Winter or Christmas without any problem, as long as there was no intent to push any one religion.
So Petoskey will join most, but not all northern Michigan School districts in calling the break Winter Break. But what do you think about the board's decision?
