(AP) -- Ex-Detroit Mayor Kwame Kilpatrick will learn Thursday if a request to disqualify a judge hearing his restitution case has been granted. Wayne County Circuit Presiding Judge Timothy Kenny says he'll rule at 9 a.m. Thursday on the motion Kilpatrick's attorney filed to remove Judge David Groner.
Michael Alan Schwartz says Groner has a bias against his client and says the judge had improper communications with prosecutors on a bench warrant charging Kilpatrick with probation violation. The disqualification motion was appealed to Kenny after Groner denied it.
A warrant was issued for Kilpatrick after he failed to make a $79,011 restitution payment last month. Kenny entered a not guilty plea.
